The large number of applications in practice has revealed the inadequacy of the criminal remote court system.The intervention of information technology has led to a great change in the way of court hearing,but the rules of operation of criminal remote court hearing are still dominated by the traditional rules of criminal procedure,and the criminal remote court hearing system needs to be improved.This paper analyzes the shortcomings of China’s criminal remote court system and proposes corresponding countermeasures by examining the concept of criminal remote court hearing and combining the current situation in practice with the examination of overseas systems.The first part briefly introduces China’s criminal remote court hearing system.While China’s criminal remote court trial has achieved good results in practice,its application also possesses certain risks.The second part examines and draws on the provisions of criminal remote court hearing in foreign countries and regions.All foreign countries and regions have adopted statutory laws to clarify the application of criminal remote court hearings,and the focus of the institutional regulation is mostly on the protection of the rights of the prosecuted.The third part analyzes the shortcomings of China’s criminal remote court system in the light of the current situation in practice.The criminal remote court hearing system in China is obviously power-oriented,the norms of remote court hearing are fragmented,the collaboration mechanism of judicial organs is missing,and the technology in the criminal remote court hearing system is not regulated and guaranteed.The fourth part puts forward corresponding suggestions for improvement in view of the aforementioned problems in China’s criminal remote court system.The principle of limiting power and safeguarding rights should be implemented in the criminal remote court trial,so the judicial responsibility of the judicial organs in the remote court trial should be strengthened,and the rights of the defendant and the defense should be protected and safeguarded;a complete procedural system is the requirement of the principle of due process for the criminal remote court trial,and the scope of application of the criminal remote court trial should be clarified as soon as possible and the procedural rules should be improved on this basis;at the same time,in order to maximize the advantages of the criminal remote court trial system,the system should be established.At the same time,in order to maximize the advantages of the criminal remote court trial system,a linkage mechanism of judicial organs should be established in the criminal remote court trial to break the information silos and regulate the collaborative behavior;in addition,a corresponding platform and hardware standard should be established to regulate technology,which is an important role in the criminal remote court trial,and at the same time,network security should be strengthened to optimize the judicial technology means to promote modern technology to serve justice and maximize the advantages of the criminal remote The advantages of criminal remote court trial should be maximized.
