| The land issue is related to the food security of the country and the basic survival needs of the people.It is fundamental to the livelihood of the people and is very important in the contemporary social and economic development.China has always attached importance to the survival of farmers,land issues into the national development strategy,pay attention to farmers’ basic living needs.Due to the small amount of cultivated land resources in China,the state attaches great importance to the protection of cultivated land,and puts forward the basic state policy of "very cherish,rational use of land and practical protection of cultivated land".The state has issued a series of legal systems to ensure the implementation of land policies and severely crack down on land violations.All parts of the country failed to implement the farmland protection policy,also issued local legislation to stop.At present,although the frequent and frequent occurrence of illegal land use cases has been effectively curbed,the complaints,letters and visits of illegal land use still remain high,the historical problems still need to be dealt with,and the efficient and powerful handling mechanism needs to be improved.Based on illegal covers such administrative accusing the compulsory execution as the research object,combined the actual legislation,administrative law enforcement,judicial,administrative penalties by investigating illegal behavior person,check the file information,administrative accusing the review analysis,discussion to visit,communicate with related comrade learning way,such as administrative accusing the strong enforcement of those illegal covers an area of class analysis.The administrative non-litigation compulsory execution of illegal occupation represents the law enforcement capacity of administrative organs and the judicial level of the court.Facing the complicated administrative non-litigation compulsory execution of illegal occupation,how to form a joint force in each link to reduce the occurrence of illegal occupation behavior is of great significance to improve the national governance capacity.In order to better solve the problems of concern in practice,maximize the protection of national land and food security,and safeguard the legitimate rights and interests of the people,the author starts from the concept and nature of administrative non-litigation enforcement of illegal occupation,and sorts out the existing laws.This paper analyzes the outstanding problems encountered in administrative law enforcement,administrative non-lawsuit review and execution,and puts forward solutions to the existing problems. |
