In the study of bank bankruptcy system,most scholars seek western experience,but the bank bankruptcy system and practice in modern China are relatively rich,which can provide useful enlightenment for the contemporary bank bankruptcy system.The modern bank bankruptcy system began with the introduction of bankruptcy and bank.In the process of concept evolution into system,modern China gradually formed key legislation in the field of bank bankruptcy,such as the Bankruptcy Law of1906,the Banking Law of 1931 and the Bankruptcy Law of 1935,and built a perfect bank bankruptcy system with the participation of government,chamber of commerce,courts and other institutions.This paper starts from the content and practice of the modern bank bankruptcy system.On the one hand,it introduces the content of the bank bankruptcy system in detail along the sequence of bank bankruptcy initiation,property management,liquidation and termination,combined with the actual legislation and commercial practices at that time;On the other hand,the representative Zhen Ye Bank of China and France and Ming Hua Bank were selected from the two upsurge of bank bankruptcy in modern times.Through case analysis,it is concluded that the highlight of the modern banking system lies in emphasizing the system,paying attention to the interests of depositors and emphasizing government supervision,while the defect lies in the lack of prevention procedures,low creditor meetings and difficult termination of procedures.Finally,this paper puts forward three suggestions for the construction of contemporary bank bankruptcy system,including improving the prevention procedure,refining the start-up procedure and strengthening the security system.
