| Cross-regional administrative investigation is an administrative procedure with wider scope and more complex content developed in the practice of administrative management.Practices such as cross-regional production safety accident investigation cases in recent years have proved that cross-regional administrative investigation is an indispensable institutional measure in administrative procedures and an inevitable requirement of economic and social development for the field of administrative law.Influenced by the civil law system’s "emphasis on substance over procedure",there are few academic studies on administrative investigation.In practice,it is difficult for an administrative agency to start a cross-regional administrative investigation because of disputes over jurisdiction between different subjects.During the investigation,the legal rules on the obligation to assist different subjects are not clear enough,so that the investigation cannot be carried out smoothly.After the investigation,due to the special cross-regional makes it difficult to protect the rights of the parties to a certain extent.This paper further sorts out the common problems existing in cross-regional administrative investigation through a case of cross-regional investigation of production safety accident,and reveals the common dilemma of cross-regional administrative investigation.Legislators have not paid enough attention to cross-regional administrative investigation,and the legislation in this area is still relatively rough.,the legal norms are relatively simple.Combined with the practice of administrative management,it is proposed to establish a cross-regional administrative investigation jurisdiction dispute resolution mechanism,clarify the assistance obligations of all parties in the process of cross-regional administrative investigation,and strengthen this kind of investigation.We should improve our country’s cross-regional administrative investigation mechanism,improve the administrative investigation system,and regulate the powers of the executive. |
