Research On The Investigation Of Crimes Against Food Safety

Dinning counts most for people,of which safety comes first,food safety is closely related to people’s lives,and the food safety crimes are widely concerned by all walks of life.The Ministry of Public Security has lunched a number of campaigns in the food field for several years,which effectively fight crime and provides a real guarantee for people health and property.Since 2019,the specialist teams for food crime investigation have been set up around the country to enhance the fight against crime and create a healthy,safe and sustainable food environment for the people.But at present,the investigation of food safety crimes still faces many challenges,for example,perpetrators are active practically everywhere,the criminal activities main feature is Cross-region,the numerous people are involved and the criminal means are diversified and specialized.At the same time,with the emergence of online and offline forms of such crimes,the trend of diversification of trading forms is obvious,which increases the investigative organization’s difficulty of Investigating and controlling the goods and funds involved.For the relevant problems encountered by the investigation organizations,combining with the relevant theoretical knowledge of investigation,the author puts forward some targeted suggestions on this problems.This paper is mainly divided into three parts: The first part is mainly analyzing the constituent elements and main characteristics of the kind of crime.With the constituent elements,clarifying the composition system of evidence in such criminal investigation and sorting out the characteristics of the crime combining with judicial practice cases,and such crimes mainly have the following characteristics: perpetrators illegally use or misuse non-edible substances,crimes have larger scale and involve more regions and the crime form is mainly combined with online and offline;The second part is discussing the difficulties investigation organs encounters in the crime,the difficulties is mainly divided into four parts: 1.Investigation organs have some difficulties to seize the suspects,and it is mainly due to numerous people involved in the crime,the diversity and strong concealment of the crime means.2.There are some obstacles in collecting relevant evidence,and it is mainly demonstrated from three aspects: the anti-investigation consciousness of suspects,the cooperation degree of relevant actors and the efficiency of evidence collection.3.It is hard to investigate and control the funds related,and it mainly carries out from the three aspects of the amount involved,information mining degree and fund analysis tools.4.It is certainly difficult for the investigation organs to work with other relevant departments;The third fart is some suggestions the author put forward,aiming at the problems the investigators encountered in the work: First of all,according to the existing information and evidence,the investigators is better to choose appropriate investigation mode to follow.Secondly,investigators should grasp the focus of the site,figure out the way of inquiry and interrogation,and confuse suspects through makeup investigation.Meanwhile,investigators strengthen the investigation of electronic data and extracting them from three aspects of capital flow,logistics industry and network site,and use the video investigation to grasp the crime trends;Thirdly,the investigators try to strengthen the analysis of the fund flow through the confirmation of the funds involved and the use of the relevant fund analysis tools;Finally,the investigators can strengthen the cooperation effect and improve the clean-up rate through remote cooperation,cooperation with financial institutions,appraisal institutions,market supervision and administration and other relevant institutions or departments.The author hopes that from the perspective of food investigation,analyzing the difficulties investigators encountered in crime,combined with the cases,there can be an effective countermeasures to provide some reference and ideas for the investigators.
