Reconstruction And Development Of Litigation Mediation Docking System

With socialism with Chinese characteristics entering a new era,China’s development has a new historical orientation.However,the basic national conditions of our country have not changed.The contradiction between the people’s growing need for a better life and the unbalanced and inadequate development has always run through the whole process of the primary stage of Chinese socialism and all aspects of social life.With the great changes in economy,politics,culture and society,and the awakening of people’s consciousness of rights,various contradictions and disputes inevitably arise,which present a complex situation of multiple interwoven.However,the existing traditional dispute resolution method ‘Fengqiao Experience’or the traditional people’s mediation system is difficult to effectively deal with these new situations and changes,which is not only related to social stability and harmony,but also attracted the party and the state’s high attention.Based on the reality of ‘Fengqiao Experience’,this paper introduces the docking of litigation and mediation to achieve effective convergence,promote its legalization and institutionalization,and strive to solve its dilemma.The first chapter mainly introduces the background and significance,the definition of related concepts and the research status at home and abroad.The second chapter introduces the historical value and practical dilemma of the ‘Fengqiao Experience’;the third chapter introduces the docking system of litigation and mediation from solving the dilemma of the ‘Fengqiao Experience’;the fourth chapter discusses the practical exploration of the docking system of litigation and mediation;the fifth chapter draws on the beneficial experience of the docking system of litigation and mediation abroad;the sixth chapter makes prospects for the perfection and development of the docking system of litigation and mediation,and puts forward suggestions;the seventh chapter is the conclusion It concludes that the litigation mediation docking system has realized the system and value perfection of ‘Fengqiao Experience’.
