The new coronavirus pneumonia that swept the world in 2020 has brought about a great impact on the lives and social development of various countries and their people,thus bringing the issue of legislation on the prevention and control of infectious diseases into people’s view.The current Prevention and Control of Infectious Diseases Act was enacted in 1989,and in the prevention and control of epidemics,there are still problems of inadequate legislative principles and imperfect legislative content,which are reflected in the lack of protection of the rights of the relatives,the principle of relying on the public,the imperfect design of the isolation system and the lack of independence of the relevant institutions.This article proposes the following suggestions to improve the Prevention and Control of Infectious Diseases Law,based on the above problems,through the study of the Prevention and Control of Infectious Diseases Law and comparison with relevant legislation in foreign countries.Firstly,a provision on the principle of reliance on the masses should be added to the provisions.Secondly,the right to information,the right to protection of personal information and the right to medical assistance should be improved in order to strengthen the protection of the rights of the administrative counterparts.Secondly,the legislative content of the Prevention and Control of Infectious Diseases Act should be improved.By sorting out the isolation system,we propose to clarify the terms used in the isolation procedure,the cost and duration of isolation,and refine the regulations on the disposal of companion pets during the isolation process,and suggest that the powers and responsibilities of disease control agencies should be improved in the legislation.The Infectious Diseases Control Act,as China’s specialised law for the control of infectious diseases,is an important guide to the prevention and control of infectious diseases and should be clearly positioned in the process of enactment to protect the rights and interests of the present and stabilise the long-term interests.It is only by improving and optimising it that the Law on the Prevention and Control of Infectious Diseases will be able to play its proper role in the field of public health.
