Research On Copyright Protection Of Artificial Intelligence Products

The promulgation of the Copyright Law aims to stimulate creation and promote the development of socialist cultural undertakings,and the two complement each other.In recent years,with the advancement of big data network and Internet technology,artificial intelligence has been breaking into human life at an unexpected speed.The appearance of artificial intelligence is the crystallization of human intelligence,and the evolution of artificial intelligence products is the highest representation of the perfect combination of human intelligence and intelligent technology,and it is also a challenge to maintain the balance of the internal purposes of the copyright system.Nowadays,it is an inevitable trend for artificial intelligence to enter the field of literary creation.How to give necessary copyright protection to artificial intelligence products is a thorny problem we are facing.For copyright protection,which caused by the product of artificial intelligence copyright system should be in an open and tolerant attitude,with the system itself has adjustment ability,actively reasonable regulations to artificial intelligence products,not the past,because of their fear of new things out of sight protection.The addition of new technology is a boost to the development of copyright,not a threat.In fact,back in the 1950s,Alan Turing proposed his famous thought experiment,which started the speculative exploration of artificial intelligence.Based on now available study,this paper starts from the theoretical level,with the basic principle of the production of artificial intelligence products as the breakthrough point to have a brief understanding of it,and according to the "degree of intelligence" of artificial intelligence for a simple classification.After reading a lot of relevant literature,I found that the research on copyright protection of ARTIFICIAL intelligence products should be based on the qualitative research of artificial intelligence products,but there is no consensus among academics.This paper analyzes the rationality of defining artificial intelligence products as works from the perspectives of originality,replicability,perceivable external expression,and intellectual achievements in the field of literature,art and science.Then it briefly analyzes the status quo of legislation in China,and reveals the judicial dilemma of copyright protection of artificial intelligence products in China by analyzing typical cases.Artificial intelligence has been progressing quickly in recent years for all countries in the world of traditional intellectual property system,panic and impact,with the continuous development of practice of all countries in varying degrees of measures were taken to cope with the challenge of artificial intelligence development to the traditional copyright,based on the investigation of the UK,Japan,the United States,the European Union legislation mode and practical experience in many other countries,take the essence to the dregs,The positive enlightenment to the copyright protection of artificial intelligence products in China is summarized.Finally,based on the reality and national conditions,the author puts forward some proposals on the perfection of the copyright protection system of ARTIFICIAL intelligence products in China,such as clarifying the legal concept and nature of artificial intelligence products,determining the protection period,and clarifying the copyright ownership of artificial intelligence products in legislation.Mechanism,establish a new copyright registration is generated in the course of intelligent use of situation and puts forward the idea of the tort liability,at the same time,in view of "artificial intelligence products protected mode" also controversial in academic circles,also made corresponding introduction in this paper,the main mode and based on the multiple considerations to the selection and comes up with some recommendations of protection in our country.Artificial intelligence is an important symbol of social development and science and technology driven,lack of relevant systems in the field of copyright will severely slow down the progress of the development of artificial intelligence,through the study in the hope to settle a matter of artificial intelligence products and provide the corresponding train of thought,concrete measures to promote the product of artificial intelligence I am contributing fully in the field of copyright protection.
