Research On The Participation Of Prison Police In Community Correction

Since the community correction work was carried out in China in 2003,it has not only saved a lot of penalty costs for the country,but also played a positive role in maintaining social stability and effectively prevented the occurrence of crimes.Community correction in China,as an "imported product" drawing lessons from western experience,will inevitably encounter various difficulties and problems in the process of development.Although the Community Correction Law of the People’s Republic of China has been officially implemented in July 2020,which has solved many practical problems from the legal level,there are no clear provisions on the common situation of borrowing police in the practice of community correction.Therefore,how to further regulate the use of police in community correction is worth our research and discussion.This thesis takes the prison police’s participation in community correction in S Province as an example,uses case study method,semi-structured interview method,combined with the new social defense theory and seamless government theory,analyzes the necessity of prison police’s participation in community correction,introduces the main practices,analyzes the difficulties and causes,and proposes improvement measures.First of all,combined with relevant examples,from the community correction of seamless management requires the participation of prison police,prison police has the unique advantages of the implementation of the new social defense theory two aspects elaborated the necessity of prison police involved in regulation of community correction,the early stage of the review S province prison police to participate in the four patterns of community correction,and combined with the two aspects of individual and whole instances and data,this thesis introduces the main methods of prison police participating in community correction in S Province.Secondly,by analyzing the relevant data of 185 prison police selected by S Province from September 2020 to August 2021 to participate in community correction,it is found that the main difficulties are that prison police have no law enforcement power of community correction,lack of scientific police force allocation,difficult to solve the problems of work and life security of prison police,and difficult to realize dual management.The causes include inadequate laws and regulations,inadequate police resources due to COVID-19,and the incomplete establishment of the seamless government concept.Finally,improvement measures are put forward:first,the work responsibilities of prison police in community correction are clarified,that is,clarify responsibilities from the legal level,clear responsibilities from the institutional level;Secondly,to strengthen the construction of prison police team in the of community correction,that is,to optimize the police mechanism,improve the seamless security system,and strengthen the work training to cultivate community correction generalists;The third is seamless cooperation between prison police and other subjects,that is,smooth information sharing channels,realize seamless cooperation within the judicial administrative system,promote seamless cooperation with public security organs,promote seamless cooperation with public service departments,and strengthen seamless cooperation with social forces.
