Research On Protection Of Personal Information In The Area Of Internet Credit

In recent years,the credit reporting industry of China initiates a golden period.Under the technical impetus of the Internet and big data,various small and medium credit bureaus have emerged rapidly,increasingly expand the coverage areas of personal credit information,and provide effective complement for the credit information database of People’s Bank of China.However,in the Internet age,the traditional pattern of credit supervision can not adapt to the market trend of credit,and lagging laws and regulation systems cannot solve the problems appeared in the field of Internet credit,such as inundated general authorization,identity information leakage,fake loans and information asymmetry,leading to severe challenge for personal credit information security.Since 2005,the People’s Bank of China has constantly issued a number of documents to regulate the credit reporting industry.The State Council issued the Regulations on the Administration of Credit Reporting Industry in 2013,giving individual credit subjects the rights of consent and decision making.The Law of the People’s Republic of China on Personal Information Protection was officially adopted in 2021,which has opened a new door for the protection of personal information in China.But there is no specific,systematic and advanced legal norms as the basis and support for the protection of personal credit information yet,which not only seriously restricts the standardized development of China’s credit reporting industry,but also brings many challenges to the security of personal information.Therefore,it is necessary to study the protection of personal information in the field of Internet credit in China from the legislative and practical levels in order to constantly improve the relevant system.Combining with the legal provisions in the field of credit and personal information protection in China,in the form of case analysis,this paper analyses the current outstanding problems that exist in the credit market,provides solutions for current problems existing in the Internet personal credit by means of discussing the foreign credit legislation and regulatory modes of the United States,the European Union and South Korea,and then optimizes the regulatory path of personal credit from multiple perspectives.The first part,starting from the basic category of personal information protection in the area of credit,summarizes the new characteristics of personal information protection in the area of Internet credit by analyzing the relationship between personal information in the area of credit and general personal information,and combining the differences between the Internet credit mode and traditional credit mode.The second part mainly introduces the current legislative situation of personal information protection in the area of Internet credit of China,and then sums up the current problems in the Internet credit market,including inundated general authorization of the credit platforms,intervention of the third party credit agency resulting in information asymmetry and limited right to relief of personal information subjects.The third part is a comparative study,focusing on the personal information protection legislation and credit supervision practice of the United States,the European Union and South Korea,providing new ideas for China to solve the problems of personal credit information security.The fourth part aims at the new problems in the personal credit market and combines foreign experience to optimize the regulation path of personal credit in China from multiple aspects,including improving laws and regulations as well as the credit supervision system,and establishing an Internet credit relief platform.
