Problems And Countermeasures Of Criminal Legal Aid In Yanbian Prefecture

The purpose of this research is to reveal the basic situation of the efforts made by the criminal legal aid work in Yanbian Prefecture to meet the requirements of this reform under the background of "full coverage of criminal defense",the practical difficulties encountered in carrying out the criminal legal aid work,analyze the potential causes of the difficulties,and how to care for the development of the criminal legal aid work through support and assistance measures,enhance the working enthusiasm of criminal legal aid lawyers through positive stimulus measures,realize the positive interaction with the criminal legal aid recipients,influence the trial entity results to a greater extent,and safeguard the legal rights and interests of the recipients.In the process of research,literature research,comparative analysis and empirical analysis under certain conditions are mainly used.First of all,it analyzes the reform situation of full coverage of criminal defense,clarifies the meaning of full coverage of criminal legal aid,takes intersubjectivity and effective defense as the theoretical basis,highlights that criminal legal aid should guarantee the "subjectivity" of the accused,provides diligent and conscientious legal services for the accused,enhances the identity of the accused with substantive results,and puts forward higher requirements for the effect of criminal legal aid.Especially in the analysis of the actual situation of the criminal legal aid in Yanbian Prefecture,the author adopts the comparative analysis of the case in Yanbian Prefecture and the general situation in Yanbian Prefecture,summarizes the difficulties of criminal legal aid in Yanbian Prefecture,and the three-stage analysis method of the practical reasons reflected by these difficulties,and makes statistics on the case sources,recipients,handling situation and funds guarantee of the criminal legal aid work in Yanbian Prefecture.Further reveal the actual situation and awkward situation of criminal legal aid in economically underdeveloped areas.This paper also puts forward some theoretical thoughts.In the future construction of legal aid system,we need to pay attention to the core position of criminal legal aid in the whole legal aid system,make personalized system construction,strengthen professional division of labor,and reverse the present situation of civil legal aid that gives way to people’s livelihood.
