On The Improvement Of The Registration System For The Transfer Of Land Management Right In China

With the further development of the market economy and the implementation of the "three-rights separation" of agricultural land,the transfer of land management rights will surely become an important part of the new round of rural land reform and occupy a more important position in the economic life of farmers.However,it seems that the transfer of land management rights still faces many obstacles,and the registration system for the transfer of land management rights that still has many defects is one of them.In order to remove obstacles to the transfer of land management rights and protect the interests of farmers,my country should improve the registration system for the transfer of land management rights.Precisely under this logical premise,this article starts with the connotation of the registration system for the transfer of land management rights,combined with the legal provisions of our country and the actual situation of the transfer of land management rights,comprehensively analyzes the problems existing in the registration system for the transfer of land management rights in my country,and analyzes the reasons.,And finally put forward a path to improve the registration system for the transfer of land management rights.The full text is divided into four parts.The first part is the connotation of the registration system for the transfer of land management rights.Taking into account the status of local government’s performance of functions and the supporting system for registration of land management rights transfers,it has a profound impact on land management rights transfer registration.This article believes that when defining the connotation of the land management rights transfer registration system,it is not only necessary to consider the registration of land management rights transfers.In the registration act itself,attention should also be paid to the performance of government functions during the registration process of the transfer of land management rights and the related supporting systems for the transfer of land management rights.The second part is the problems existing in the registration system for the transfer of land management rights.Starting from the provisions of the Land Contracting Law,this article combines the function performance of local governments in the registration process of land management rights transfer and the status quo of supporting systems,and comprehensively analyzes the problems existing in the registration system of land management rights transfer.It mainly includes three aspects.:Lack of legal regulations,unreasonable performance of local government functions,and imperfect supporting systems.The third part is the cause of the problem of the registration system for the transfer of land management rights.This article focuses on the three problems in the registration system for the transfer of land management rights,and analyzes their causes:First,the lack of legal provisions is due to the unclear understanding of the nature of land management rights by legislators;second,the performance of local government functions The unreasonable reason is that the transformation of government functions is lagging behind;third,the imperfect supporting system is due to the insufficient attention paid by the government and legislation to the transfer of land management rights.The fourth part is the path to improve the registration system for the transfer of land management rights.Aiming at the problems in the registration system for the transfer of land management rights,and combining the analysis of the causes of these problems in the previous article,this paper proposes ways to improve the registration system for the transfer of land management rights.First,improve the registration legislation for the transfer of land management rights and solve the problem of lack of legal regulations.;Second,clarify the functions of local government and solve the problem of unreasonable performance of government functions;third,improve the supporting system for the registration of land management rights to solve the problem of incomplete supporting systems.
