Study On The Causes And Legal Measures Of Rural Collective Drug Production

With the rapid development of urbanization in China,more and more people leave relatively remote rural areas to urban development.Because of its small population,away from the center of political power,weak police force and huge clan power,rural areas have become the extrajudicial place in the hearts of more and more criminals,especially to control drug trafficking.Because of its profiteering,the crime of drug trafficking is easy to develop and grow in rural areas with poor economic income,weak legal consciousness of the masses and close kinship.In addition,the lack of education and confusion about the way out of rural teenagers are more likely to be contaminated with drugs,which encourages the development of drug-making crimes in rural areas.Take Bo’s village,On 29 December 2013,Guangdong Provincial Public Security Bureau to organize the "Thunder sweep drugs" special action,More than 4000 armed police officers and special police officers were involved in the encirclement and arrest of Boshe Village in Shanwei City,Guangdong Province,77 laboratories were destroyed,Collection of 3 tons of finished drugs,The raw materials for drug production are 25 tons.This is the first case of drug production in rural areas since the founding of the people’s Republic of China.More than 14000 people in the whole village have indirectly and directly participated in more than 10000 people,which is shocking and sounded the alarm bell for the national drug control behavior.Through the analysis of the case of drug production in rural areas of Boshe,this paper summarizes the causes of drug production in rural areas as the weak legal consciousness of villagers,the failure of grass-roots management organizations,the deep influence of clan culture,the weak crackdown on drug production,the protection of local umbrella and the psychological needs of crime.Rural residents lack self-control in the face of the profiteering caused by drug-making crimes because of their low education level general lack of legal consciousness;as the grass-roots administrative organizations of the government,the two rural committees,as the current Organic Law of the Village Committee on elections and supervision,lead to illegal and criminal personnel stealing the power of grass-roots management organizations,thus providing shelter for drug production;Clan members in areas with strong clan culture often strengthen their links through clan councils,which are not yet recognized by the state at the legal level,so the lack of supervision and management at the legal level will have serious consequences once they are used by interested people.By strengthening the work of popularizing the law in rural areas,strengthening farmers’ legal consciousness,perfecting the relevant laws and regulations of grass-roots management organizations,guiding clan forces with the spirit of rule of law and strengthening the crackdown on drug crimes according to law,the negative influence of clan forces on rural areas is weakened and the probability of drug production crimes in rural groups is reduced.To avoid the failure of grass-roots management organizations by improving the Organic Law of the Village Councils and establishing democratic supervision of administrative proceedings,while limiting the proportion of the population of the villages that do not live in rural areas participating in elections;and to cut off the source of drug production by establishing in the Criminal Code the crime of illegally possessing raw materials for the production of drugs and imposing a large amount of fines;By including some of the positive patriarchal councils in the management of social organizations and giving the patriarchal councils the status of legal subjects,the supervision of the patriarchal councils can be strengthened according to law,and the patriarchal councils that violate the law are punished or even banned according to law.In order to avoid clan forces become a group drug-making umbrella.From the legal level,we should strengthen the supervision of grass-roots management organizations,guide clan forces and crack down on drug production crimes,avoid the emergence of drug production behavior in rural groups from the source,and avoid the emergence of more "Boshe Village" from the source.
