Study On Dereliction Of Duty From The Perspective Of Economic Interests

With China entering the new normal of anti-corruption,malfeasance has been paid more and more attention.Dereliction of duty is manifested in the fact that state functionaries are not responsible or responsible for their work,violate the principle of duty,violate laws and regulations,and endanger social order.The existing researches have expounded the mechanism of economic interest in corruption and bribery from different perspectives,but few have explored the economic interest factors in dereliction of duty.Based on the perspective of economic interests,this paper analyzes malfeasance,explores the composition and influence of economic interests in malfeasance,combs the logic of malfeasance under the role of economic interests,so as to provide ideas for the prevention of malfeasance.This paper takes the judgment of dereliction of duty as the object of analysis,based on the theory of public choice,the theory of principal-agent,the theory of administrative ethics and the theory of rent-seeking,and discusses the economic interest factors in dereliction of duty.First of all,three kinds of causes under the crime of dereliction of duty-abuse of power,dereliction of duty and bending the law for personal gain are taken as the objects,and the text of the above three kinds of criminal judgments are analyzed by using R language to explore the characteristics of dereliction of duty;Secondly,it analyzes three different types of malfeasance cases to explore the logic of malfeasance under the guidance of economic interests.Finally,through the comparative analysis of different stages of malfeasance judgments,it explores the different characteristics of malfeasance before and after the 18 th CPC National Congress.It is found that: economic benefits are one of the causes of malfeasance,which have different proportion in different types of malfeasance,and have more and more profound influence on malfeasance;malfeasance and corruption and bribery are intertwined,and there are profound economic motives behind the malfeasance;the subjective aspect of malfeasance is the combination of negligence and intention,and the objective aspect is the combination of action and inaction For the combination.Based on the results of the above text analysis and case analysis,this paper believes that the legal system should be improved to provide institutional guarantee for the prevention of malfeasance;the supervision mechanism should be improved to eliminate the gap between power and money;the incorruptible education should be strengthened to improve the ability to resist corruption and change;the wage level should be improved to establish a reasonable salary and welfare system;social guidance should be strengthened to build a participatory governance network.
