| The shared-ownership housing is one of the new affordable housing developed in china in recent years.The core concept of it is to build a divided co-ownership between the government and the buyers(recipients).The recipients can purchase part of the property rights of the house,thus greatly reducing the pressure on house purchases.China has begun to pilot the shared-ownership housing system in Huai’an City,Jiangsu Province since 2007,and subsequently expanded the scope of pilot cities.It has been explored for more than 10 years till now.However,China does not form a unified system of shared-ownership housing.At the legislative level,there is also a lack of provisions at the level of the basic law.As a result,local policies vary widely in practice,and the Administration of access and exit of shared-ownership housing is not uniform.Through the perspective of the access and exit system,the article explores the methods to improve the system of shared-ownership housing in China.The article begins with the concept and legal basis of shared-ownership housing,defines the nature of it,discusses its legal legitimacy,and points out the issues in the current exploration of this system;Secondly,the article reorganizes the theoretical basis that should be followed in establishing the access and exit system for shared-ownership housing,including the principle of guaranteeing citizen housing rights,fairness,efficiency,and sustainability,thus providing an instruction for the establishment of access and exit systems.Thirdly,the article provides a foreign reference for the establishment of China’s corresponding access and exit system by expounding the access and exit systems of the United Kingdom,the United States,Singapore,and Australia.Furthermore,the key parts of the article is to establish the access and exit system of China’s shared-ownership housing.In terms of the access system,the article establishes the access system from three aspects:defining the recipients,clarifying the proportion of shared-ownership,and entering the implementation procedures.In terms of exit system the article divides the exit system into voluntary withdrawal and forced withdrawal In voluntary withdrawal,the article clarifies the rules for "restricted disposing period" and "resale object",and in forced withdrawal,the article specifies the corresponding reasons and established supporting enforcement measures in civil,administrative and criminal aspects.Finally,the article provides legislative advice on the system of shared-ownership housing in the Housing Security Law,and believes that it is necessary to define the definition of recipients,the verification of the proportion of shared-ownership,the circumstances and reasons for withdrawal,and the corresponding enforcement measures. |
