Law And Economics Analysis Of Project Bidding

With the development of China’s reform and opening and the establishment of Socialist Market Economic order,the rapid development of Construction Industry has made an outstanding contribution to our economic construction.However,behind the prosperity and development of the construction industry market,some practical problems can’t be ignored,the most prominent one of which is the collusion in bidding.In recent years,project bidding problem has become a social hotspot.But in legal theory circle and practice circle,the research has not made some substantial progress,only on some specific forms of project bidding and so on.With the help of analyzed tools of information economics and the related theories,this article regards several influential cases which have occurred in the last few years as a starting point and analyzes the reasons.And on the basis of the above analysis,the article proposes the solution.The purpose of my paper is to arouse the attention of the theory circle and practice circle to not only the problem of project bidding but also the related problems.This article,which is divided into six parts,adds up to 22000 words.The problem put forward is the start of this thesis.The author regards several influential string cases which have occurred in the last few years as a starting point and points out the existence and the seriousness of current problems in engineering bidding and the main problems needing solving in the paper,that are the reasons of engineering bidding and the solution of it.Part One:The first part is the study of our theory circle on the present situation and reflection on it.During the recent twenty years,the research of our legal theory circle on engineering bidding has never stopped by searching the CNKI.In this paper,the scholars’ research results are summarized in brief.Part Two:The laws and regulations of engineering bidding market mainly contain two parts.On the one hand the author combs out of some normative legal documents of the recent twenty years which have taken place in the project bidding market through searching the Lawyee Net.On the other hand,the author sums up the related legal systems with a combination of research results,Part Three:The analysis of the reasons leading to the engineering bidding is the key content of this paper.Firstly,with the help of the model of Game Theory,the author carries on a further research on the behavior of the engineering bidders,makes a comparative analysis on all kinds of behavior strategies and then puts forward the engineering string reasons.Secondly,in combination with the related knowledge of the Repeated Games,the author summarizes other factors,mainly including the reputation mechanism,the speed and cost of information dissemination and the mediation system.Part Four:The fourth part is the solutions of engineering bidding.After the detailed analysis of the resulting string reasons,the next task is how to solve the problem of engineering bidding.Based on the third part,this part is to discuss how to solve the problem of engineering bidding,mainly from the aspects of the information economics,which includes the exclusion of common threat and the expansion of the information exchange.In the end,the paper stresses the importance and necessity of the study on engineering bidding again,makes a summary of the content and gives a few brief descriptions.
