| The China Law Review and The Magazine of Aurora University are two representative periodicals in the field of law in the Shanghai International Settlement during the Republic of China,especially The China Law Review,which achievements,reflection and influence on the forefront of legal scholarship at that time are recognized by the current academic circle.In addition,these two periodicals were founded earlier and issued for a long time,which can be said to basically witness most of the development process of the law field in the Shanghai International Settlement in the Republic of China.Therefore,to study them is not only to better know the basic situation of the Shanghai International Settlement law research during that period,but also to commemorate the precious and memorable academic process.The research object of this paper is the legal research of the Shanghai International Settlement in the Republic of China period,that is,the articles published in The China Law Review and The Magazine of Aurora University are sorted out and summarized,in order to find the research fields that scholars paid attention to at that time,and to sum up certain research rules and changes.This paper includes three parts: Introduction,body and conclusion.The introduction mainly includes the reason of topic selection,literature review,research objects and data sources,research methods,research innovations and difficulties.There are four chapters in the body,which are described as follows:The first chapter mainly summarizes the background of legal research in the Shanghai International Settlement,through the rise of the rule of law trend in the late Qing Dynasty and the early Republic of China,the prosperity of legal education and the publication of legal journals,and then leads to the representative journals The China Law Review and The Magazine of Aurora University as the main research object of the law research of Shanghai International Settlement.The second chapter sums up the concrete situation of the articles published in the The China Law Review and The Magazine of Aurora University from the three angles of the quantity of articles,column arrangement and author situation,after each objective induction,the author adds some analysis or opinion,trying to show the basic situation of legal research in Shanghai International Settlement,and improve the objectivity and theory of the article.The third chapter takes the law courses of The Comparative Law School of China and Aurora University as the starting point,combs through the classification of discipline of The China Law Review and The Magazine of Aurora University,and analyzes the research field of legal research.Through analysis,it is concluded that constitutional and administrative law,civil law,criminal law,international law,economic law,judicial system and legal professional ethics have become the focus of legal research in the Shanghai International Settlement during the Republic of China.The fourth chapter summarizes and analyzes the law of change in the legal research of Shanghai International Settlement from 1920 to 1941,as well as the characteristics of the legal research of Shanghai International Settlement compared with non-concession law,and reflects on the existing problems of law research at that time and what inspiration it has for modern legal research. |
