Study On The Legal System Of Salt Industry In Qing Dynasty

After thousands of years of development,the legal system of salt industry had been relatively comprehensive and complete until the Qing Dynasty,involving all links of salt production,transportation and marketing,including regulations on salt management organizations and personnel,legal systems for salt production management,legal systems for salt transportation and marketing management,and legal regulations on smuggling activities.And according to the actual situation of the system operation in different periods,the Qing government would improve and reform the system by means of interpreting laws,legislating laws and issuing relevant decrees.The formation and development of the legal system of salt industry in the Qing Dynasty reflected the distinct characteristics of The Times and political needs.From the institutional level,a relatively complete system was constructed,which made every link of salt circulation have laws to follow.A relatively perfect anti-smuggling mechanism was established to restrain the development of salt smuggling activities by means of post-supervision.However,because of the gap between the system design and the actual effect of the implementation,the Qing government had to carry out the relevant reform measures to ease the contradictions between officials and private,and solve the disputes in the salt affairs.The reform and improvement of the legal system of the salt industry was a salvation movement taken by the Qing government to restrain the salt smuggling activities.The implementation of relevant reform measures was to maintain the stability of the feudal monarchy and protect the fundamental interests of the bureaucracy,so once the reform touched the interests of these people,it would be declared an end.It can be seen that the legal system of the salt industry in the Qing Dynasty has its inherent drawbacks.If the management system of the salt industry remains unchanged,just modifying the content of the legal system for details can not meet the needs of the increasingly developing commodity economy and industrial diversification.Therefore,the contemporary government should sum up the previous experience in the management of salt industry,change the previous management mode,and play the role of macro-control in the market operation.We will relax the market access mechanism and participate in the management of the salt industry through prior review and post-supervision.In particular,we should pay attention to the supervision of salt quality and safety,the development of people’s livelihood,purify the salt trading market and ensure people’s safe use of salt.
