Research On The Practice Of Civil Dispute Mediation From The Perspective Of Folk Negotiation

This paper takes the mediation practice of civil dispute mediators in L village of Shanxi Province as a case study to explore how pollsters mediate civil disputes before they rise to legal settlement,and what role civil mediation plays in the village.The civil mediator is an institutionalized identity granted by the government,while the pollster has non-institutionalized power and identity.These two identities jointly construct the authority of the civil dispute mediator in the village.This paper selects three typical cases of family conflict,neighborhood friction and village dispute handled by civil dispute mediators,and discusses the specific process of mediation practice of pollsters.In the mediation process,the "discretion officer" mainly uses the three mediation mechanisms of "emotion","reason" and "law" to penetrate the local knowledge,dissolve the internal contradictions in the village,stabilize the order of village life,and let the life continue as usual.
