With the continual deepening of the ageing problem, more and more attention has been paid to issues of aging in safeguarding legal rights.Although there are more and more diverse ways to mediate conflicts and better mediation mechanisms, mediation activities involving older people are often considered less efficient and encounter difficulties such as older people’s poor communication, unclear expressions, hindrance of terminology understanding, and frequent interrupted statements during the mediation process. This thesis takes the discourse interaction involving the elderly in the mediation process as data, and analyzes in three dimensions: lexical choice, turn design, and sequence organization,to explore the conversational characteristics of the elderly people in the typical institutional discourse of mediation activities, the types of identity constructed by elderly people through discourse resources in inherently asymmetric institutional conversations, and the constraints in the process of identity construction. It was found that in the process of mediation,in addition to default identities, the elderly constructed identities such as strong-weak identity,rational-emotional identity,respectable-rude identity by discourse. These deviational identities are constructed under the combined constraints of the institutional nature of mediation discourse, and the specificity of the elderly, embodied in their cognitive abilities, physiological functions, psychological characteristics and social factors. Finally, try to change the stereotype of the elderly and giving enlightenment on language services for mediation agencies to better serve the National Strategy on Active Aging.
