| The Qin dynasty was a dynasty renowned for its heavy penalties in Chinese history.Its heavy penal principles and system were an important part of the rule of law in ancient China and still have important historical value and research significance,and had a profound impact on Chinese feudal society.The Bamboo Scrolls from the Sleeping Tiger Tomb are an important historical source for documenting the legal system of the Qin Dynasty.In the Bamboo Scrolls from the Qin Tomb at Sleeping Tiger,the content of the heavy penalties of the Qin dynasty is recorded in the form of questions and answers,mainly concerning the crimes and names of the heavy penalties,specifically,the crimes against the security of the Qin dynasty and the monarch,crimes against personal rights,crimes against property,and the names of the penalties include life,flesh and shame.The heavy penalties in the Bamboo Sketches from the Qin Tomb of Sleeping Tiger should be viewed objectively,and should neither be overly praised nor dismissed in their entirety.This paper analyses and evaluates the reasons for the heavy penalties in the Bamboo Sketches from the Qin Tomb of Sleeping Tiger and the impact of the heavy penalties,through a detailed review of the crimes and the names of the penalties and a comparison of the names of the penalties with those of the Tang dynasty and the current laws,in order to enrich the theoretical research in the field of traditional criminal law. |
