Abstract/Summary:
On January 1st,2021,the Civil Code of the People’s Republic of China officially took effect,which has shown the great progress China has made on its construction of socialist rule of law with Chinese characteristics.The translation of the Civil Code could further promote the publicity of China’s legal culture.This source text of translation practice is excerpted from Chapter Two of a book named One Hundred Questions Relevant to the Civil Code And People’s Daily life.And it mainly talks about real rights.After carefully analyzing textual features of the source text,the translator decided to adopt Susan Sarcevic’s approach to legal translation as the guiding theory.According to her text typology,legal texts could be divided into three categories and the source text belongs to the second one,that’s,the source text is mainly descriptive but a little prescriptive as well and this requires the translator to adopt different translation methods and techniques to translate the source text.In this translation report,the translator mainly talked about the difficulties she met and how she handled them under the guidance of Susan Sarcevic’s theory.These difficulties are mainly from lexical level,syntactic level and textual level which include the translation of legal terms,terms with Chinese characteristics,long and difficult sentences,modals and so on.At lexical level,the translator adopted the use of equivalents,descriptive paraphrase,definition,liberal translation,addition,shift and so on to deal with these difficulties.At syntactic level,liberal translation,shift,division and addition were used to tackle the difficulties.At textual level,the translator mainly took the consistency,seriousness and preciseness into consideration.In the process of translation,the translator tried her best to conduct the language transfer as well as legal transfer to be faithful to the original text and make the translation accurate,consistent and precise.Finally,the translator finished this translation report in the hope that this practice could serve as a reference for the following translation practices.
