ObjectiveThe purpose of this article is to analyze the impact of different appraisal opinions given by various appraisal institutions and other relevant factors on the compensation amount in medical malpractice disputes,and to construct a multiple linear regression model.After a medical dispute occurs,both medical staff and patients can use this model to estimate a reference value for the compensation amount,which can provide a reasonable,legal,and appropriate reference for both parties to resolve the medical dispute,thereby avoiding a deadlock in negotiations and mediation,improving the success rate of negotiations and mediation,reducing the number of medical disputes entering the litigation stage,and avoiding waste of judicial resources.MethodsCases of medical damage liability disputes on the China Judicial Documents website were obtained,and 5928 cases were eventually obtained after inclusion and exclusion.After data classification and summarization,statistical analysis was performed using SPSS Statistics 21.0 software.The Mann-Whitney U,Kruskal-Wallis H tests,and Bonferroni correction were used to analyze the impact of different appraisal methods and related factors on the compensation amount in medical malpractice disputes.A multiple linear regression model was constructed to predict the compensation amount.Results1.Among 5,928 cases of medical liability disputes,the most common type of application was for judicial appraisal,with 5,068 cases(85.49%).The majority of cases involved primary medical accidents,with 3,312 cases(55.87%).The most common type of secondary liability case was with 1,724 cases(35.70%).The eastern region had the most cases with 2,384 cases(40.21%),and tertiary hospitals had the most cases with 3,226 cases(54.42%).2.The types of medical liability disputes with the highest compensation amounts were those involving dual appraisals(median compensation of 223,400 yuan),primary grade B medical accidents(median compensation of 633,000 yuan),equal liability cases(median compensation of 306,100 yuan),cases from the eastern region(median compensation of 235,600 yuan),cases in tertiary hospitals(median compensation of 219,100 yuan),and pediatric cases(median compensation of292,400 yuan).3.Six factors,including region,degree of injury,degree of responsibility,hospital level,appraisal method,and department,have an impact on the compensation amount for medical liability disputes.These six factors were included in a linear regression model to construct a compensation model for mental damages in medical injury cases.Conclusion1.There is a positive correlation between the level of economic development and hospital grade with the incidence rate of medical malpractice disputes and the compensation amount for medical disputes.2.According to the regression results of the model,the identification method is not an independent influencing factor of compensation amount.Hospital grade,degree of responsibility,degree of damage,dual identification in the identification method,and the departments of obstetrics and gynecology and neurology have a positive impact on the compensation amount for medical malpractice disputes.In addition,the central region,western region,and northeastern region in terms of geographic area,and the department of internal medicine have a negative impact on the compensation amount for medical malpractice disputes.3.After a medical dispute occurs,both the medical staff and patients can use the multiple linear regression model to estimate the amount of compensation,which provides a reference for the amount of compensation for both parties to solve the medical dispute in a reasonable,fair and legal manner.
