| As an important component of wetlands in China,the Yellow River Basin wetlands have unique ecological,economic,social,and scientific research values.They shoulder important missions such as conserving water sources,ensuring food security,and maintaining biodiversity.However,due to the adverse effects of economic,social,cultural,and scientific factors,the wetlands in the Yellow River Basin have been damaged,with a downward trend in wetland area and a very fragile ecological environment.In the current era of emphasizing comprehensive rule of law and promoting high-quality development strategies in the Yellow River Basin,it is necessary to strengthen the rule of law for wetland protection in the Yellow River Basin.At present,there are problems in the legislation of the Yellow River wetland,such as inconsistent basic definitions,unclear management powers,incomplete wetland utilization systems,incomplete wetland ecological compensation systems,incomplete legal responsibilities,and incomplete supervision mechanisms.The first part,the Yellow River Basin wetland protection legislation overview.By summarizing the current situation of wetlands in the Yellow River Basin,the ecological value and existing problems of wetlands in the Yellow River Basin are known,which provides a realistic basis for the legislation of protection of the Yellow River wetland.It also analyzed the necessity of improving the legislation of wetland protection in the Yellow River Basin from four aspects: the unique value of the Yellow River wetland itself,the promotion of ecological protection and high-quality development in the Yellow River Basin,the internal demand of the Yellow River basin governance by law,and the historical background of strengthening the legislation of wetland protection.The second part is an analysis of the current status of wetland protection legislation in the Yellow River Basin.Firstly,the evolution process of wetland legislation is reviewed to understand the legislative foundation of wetlands in China and the Yellow River wetland.Guided by the four stages of wetland development,the current legislative status at the national and distribution level is sorted out.The current operation of wetland protection legalization is analyzed,and the significance of current legislation for the study of Yellow River wetland legislation is summarized.Finally,the shortcomings of current legislation are summarized,Provide legal guidance for the protection of wetlands in the Yellow River Basin.The third part is the current dilemma of wetland protection legislation in the Yellow River Basin.The lack of unified basic definitions has led to confusion in the protection objects of the Yellow River wetland,unclear management powers have led to uneven distribution of functions and confusion in management,incomplete wetland utilization systems have affected the ecological value of wetlands,incomplete wetland ecological compensation systems hinder sustainable development of wetlands,and incomplete legal responsibilities have led to difficulties in implementing the mandatory and normative nature of laws The legislative difficulties faced by the Yellow River Basin wetland protection legislation are fully reflected in the incomplete supervision mechanism,which leads to inadequate effectiveness of the competent authorities’ work.The fourth part,the future Yellow River basin wetland protection legislation to improve the path.In order to achieve the sustainable development of the Yellow River basin,it is proposed to take the corresponding measures to improve the legislation on the protection of the Yellow River Basin wetland,such as unifying the basic definition of the Yellow River Basin wetland,clarifying the scope of management authority,deepening the system of wetland utilization,perfecting the wetland ecological compensation system,perfecting the legal responsibility of relevant subject and building a complete supervision mechanism. |
