Research On The Legal Regulation Of Express Packaging Recyclin

The proliferation of express packaging has become a new environmental hazard,the existing recycling mechanism in the management of express packaging pollution is stretched,relying only on moral means has been unable to cope with the environmental problems brought about by express packaging,so it is necessary to regulate the recycling of express packaging with the guidance and binding legal means stronger,so as to achieve the greening of express packaging.The legal regulation of express packaging should focus on the advantages of public and private law co-regulation.Public-private law co-regulation emphasizes public participation,multi-governance and risk sharing,which is conducive to promoting joint participation of the government and the market,and is conducive to the joint governance of multiple subjects,so as to maximize the formation of recycling synergy.At present,China’s express packaging recycling regulation has formed a public law system represented by administrative law,private law system centered on civil law,but also formed a cross-sectoral,cross-professional field of law system,these laws and regulations are interlinked and complementary,together to strengthen the rule of law foundation of public-private law co-regulation of express packaging recycling.However,there are still legal problems in the process of legal regulation of express packaging recycling,such as the absence of public law regulatory bodies,the lack of motivation of private law recycling,and the ambiguous configuration of responsibilities in the field law,which weaken the strength of legal regulation of express packaging recycling.In view of this,based on the analysis of the current situation of express packaging recycling regulation and regulation problems,this paper suggests that the synergy between public and private regulation of express packaging recycling should be enhanced by referral clauses and accompanying obligations,and then a mandatory recycling regulation system for express packaging should be built to enhance the binding force of mandatory recycling.Finally,it is also necessary to establish a sound incentive system of taxation and subsidies for express packaging recycling to stimulate the enthusiasm and initiative of recycling subjects and promote agreed recycling.Let the mandatory recycling and agreed recycling double-pronged,so as to promote the early realization of the goal of express packaging recycling.
