| Since the reform and opening up,China’s economic situation has steadily improved,but China’s environmental situation has deteriorated day by day.The report of the 19th National Congress of the Communist Party of China made a new expression of the main contradiction in our society,pointing out: " Chinese-characteristic socialism has entered a new era,and the main contradiction in our society has been transformed into a contradiction between the people’s growing need for a better life and unbalanced and inadequate development." Due to the huge consumption of resources in the process of industrialization in China,the lack of attention to environmental protection,as well as the confusion of administrative posts and the imperfection of laws and regulations,China is facing increasingly serious problems of ecological damage and environmental pollution,among which drinking water pollution is a problem that this paper focuses on.For example,the Huaihe River water pollution incident,the Tuo River 3.02 extraordinarily large water pollution accident,the pollution of the Yellow River water intake in Puyang City,and the pollution of Muyang water in Jiangsu Province have caused water pollution and difficulty in drinking water supply,and even caused casualties at worst,while these people who have become ill due to drinking water pollution have no way to complain,and their rights to body,health and life have been seriously violated.These mass incidents have caused a large impact,a wide range of people,and extremely bad social repercussions,and if not handled properly,they will inevitably cause social unrest and turmoil.Therefore,how can we promote the healthy and stable development of drinking water resources in China;How to maintain China’s natural environmental resources;How to enable our people to live in a better environment is a question that we urgently need to solve.At present,China has formed many laws and regulations for water pollution,but China’s laws and regulations and related policies have many advocacy laws,in fact,how to deal with drinking water pollution and tort liability issues are still no specific relevant provisions,so this article will also draw on foreign relevant legal theories and practices,the problem is practical and concrete,targeted to put forward relevant legal opinions,to promote China’s environmental protection,both to gold and silver,but also to green water and green mountains.Through the status of court judgments,the relevant laws involved in case judgments,and the relevant papers and laws and regulations related to environmental infringement at home and abroad in court research,highlight China’s shortcomings in drinking water pollution,environmental tort liability and other deficiencies and problems in judicial practice,and promote the progress of China’s rule of law and improve the relevant legal system.The first part is to study the connotation and characteristics of liability for damage caused by drinking water pollution.By comparing what is drinking water pollution and what is liability for damages,we will summarize and compare them through the research of various scholars and explain them clearly in more popular language.And through their own understanding to summarize,so that readers can clearly understand the relevant connotation and characteristics,and thus deepen the reader’s thinking,how to produce drinking water pollution,how to pollute,after pollution,how to compensate a series of issues.The second part,by studying and elaborating on the provisions of China’s current laws on liability for drinking water pollution damage,and finding out the places where China’s current laws and regulations are not relatively clear and the shortcomings in application,to promote readers to think about how to modify and adjust the current reality in the face of China’s legal provisions on drinking water pollution.The third part is to obtain foreign language literature through a large number of searches,research and comparison of existing foreign language literature papers,and discover the similarities and differences between foreign countries and domestic laws and regulations on drinking water pollution.In-depth study of foreign literature,extracting its essence,removing its waste,and introducing and elaborating on foreign laws and regulations suitable for China’s national conditions.The fourth part puts forward some suggestions for improving China’s drinking water pollution damage compensation system,refines China’s legal provisions in this regard,and combines relevant provisions to achieve refinement of substantive legal provisions.And some procedural matters are simplified to achieve convenient,fast,fair and just effects. |
