Research On The Improvement Of My Country's Ecological Environmental Damage Compensation Consultation Syste

In December 2015,the Pilot Program first put forward the concept of consultation on compensation for ecological and environmental damage,and to date,the consultation system for compensation for ecological and environmental damage has been transferred from pilot to practice in China,which establishes the environmental protection concept of "who damages,who is responsible" and provides a new way of thinking to solve environmental disputes.The ecological and environmental problems no longer rely solely on litigation means.The system is still in the preliminary exploration stage in China,and most of the relevant policy documents are general provisions,lacking specific operational details.Therefore,it is imperative to systematically study the consultation system for ecological and environmental damage compensation and strengthen the system design.Firstly,we will explore the basic theory of the consultation system for ecological and environmental damage compensation,clarify the difference between it and related concepts,clarify its legal nature,and construct the system.Secondly,through collecting and organizing the relevant legal norms of the consultation system at the national level and the special consultation methods of provinces and municipalities,we compare and analyze the key points of them,and try to find inspiration and similarities and differences.In addition,we briefly summarize the current situation of consultation system practice in China,and analyze the typical consultation cases published on the official website of the Ministry of Ecology and Environment,subdividing the typical cases into successful consultation cases,partially successful and partially failed consultation cases,and failed consultation cases.This will lay the cornerstone for the subsequent article.Thirdly,we will focus on the overseas negotiation systems of ecological and environmental damage compensation,and try to draw lessons from them for our country.Finally,based on the analysis of typical consultation cases in the preceding section,we give suggestions for improving the consultation system for compensation for ecological and environmental damages in China.
