Research On The Legal System Of Digital Currency Administrative Supervision In My Country

As a financial innovation in the era of digital economy,digital currency develops rapidly in the context of the rapid progress of Internet finance and blockchain technology,and has a legal impact on the existing financial system and monetary system.Digital currency has been abused in money laundering,illegal transactions and other illegal and criminal activities,and fraud and pyramid selling caused by ICO projects have been repeatedly banned.Moreover,major digital currency trading platforms frequently suffer from theft and hacking attacks,resulting in huge losses.This set of legal issues cannot be resolved by microprudential regulation of digital currencies alone.Therefore,it is necessary to strengthen the macro-prudential supervision of digital currency and construct and perfect the legal system of administrative supervision of digital currency.At present,China's administrative supervision of digital currency mainly focuses on policy document supervision and single subject supervision,and the supervision concept is rigid,the supervision method is traditional,and no systematic legal system has been formed.In the face of the rapid development of digital currency,the derivative industry is complex and diverse,and involves a wide range of fields,it is difficult to achieve effective supervision of digital currency without systematic administrative supervision.In view of this,this paper takes the legal concept of digital currency as a starting point to clarify its legal nature and analyze the necessity of legal supervision over it.Combined with the legal status quo and existing legal problems of digital currency administrative supervision,through a comparative study of foreign legal systems of administrative supervision,so as to put forward legal suggestions on constructing digital currency administrative supervision system.This paper is mainly divided into five parts: The first part is the introduction,introduces the legislation and research status of digital currency administrative supervision at home and abroad;The second part introduces the concept and legal nature of digital currency,through the comparison of similar or similar concepts with digital currency,clarify the concept and legal nature of digital currency,determine the administrative supervision object of this paper is private digital currency;The third part introduces the reasons for administrative supervision of digital currency,and demonstrates the necessity of administrative supervision of digital currency from three aspects: the value of digital currency itself,the need for risk prevention and control,and the limitations of bounded rationality.The fourth part introduces the legal status quo of administrative supervision of digital currency in China and discusses the existing legal problems of administrative supervision of digital currency.The fifth part introduces the legal system of administrative supervision of digital currency in various countries in the world,and obtains legal enlightenment of constructing administrative supervision of digital currency by studying foreign legislation and policies.The sixth part is legal suggestions on improving the legal system of administrative supervision of digital currency,starting from three aspects of reforming the concept of administrative supervision,reconstructing the subject of administrative supervision and innovating the way of administrative supervision,to build the legal system of administrative supervision of digital currency.
