Organisms in the high seas have unique scientific value and wide application prospects,but the biodiversity of the high seas is facing serious threats with the progress of technology and the excessive consumption of resources.At present,there is no special legislation for the conservation of biodiversity in the high seas,and most of the issues related to regulation are framework guidelines,scattered in different legal documents.The first chapter introduces the basic concept of biodiversity conservation in the high seas,and clarifies the development process and necessity of biodiversity conservation in the high seas.Then,by analyzing the existing international conventions and soft law documents and summarizing their shortcomings and limitations from the two levels of overall mechanisms and specific rules,this paper put forward countermeasures to improve the high seas biodiversity conservation system,including integrating and extending the existing system,recognizing the relativity of high seas freedom,distinguishing the bilayer attributes of high seas genetic resources and establishing a global legal framework for high seas protected areas.Finally,in light of China's actual situation and basic position,this paper analyzes how China should deal with the challenges from the field of biodiversity conservation in the high seas,and suggests that China should continue to advocate the concept of "community of shared future for the seas",fill the gap in domestic marine legislation,and actively participate in the negotiation of the Agreement on the Conservation and Sustainable Use of Biodiversity Beyond Areas under National Jurisdiction(BBNJ Agreement).
