Research On The Nature Of Qin Moumou's Behavior Of Spreading Rumors On The Internet

The rapid development of information network technology not only brings convenience to life and production,but also brings some negative effects.One of them is the use of network to spread false information.Such acts harm the rights and interests of the parties and endanger social order,and have their own characteristics compared with traditional defamation acts.This paper focuses on three controversial focuses of a case in Qin.The specific contents and conclusions of the study are as follows:First,the network space belongs to the public space.Network space is public and functional.The illegal and criminal activities carried out in the Internet will also cause damage to the rights and interests of victims,seriously disrupting the normal order of network space.Secondly,this paper holds that the network rumor-telling behavior can not be completely recognized as the crime of provoking trouble,and that it does not conform to the principle of legally prescribed crime.Finally,through the analysis of the criteria for determining the serious harm to social order and national interests,it is pointed out that it is the most reasonable and fair way to use the quantity of information forwarding,clicking and browsing as the criteria for determining the serious situation.This paper also puts forward the criteria for judging the serious harm to social order and national interests by comparing the impact of rumors made by public servants of different identities.
