The concept of democracy and rule of law has grown increasingly popular in the context of the reform and growth of the rule of law country and the rule of law government,as a non-mandatory and independent flexible law enforcement method, administrative interview has been widely implemented in many areas of administrative law enforcement, which has promoted the profound reform of administrative law enforcement. However,as an emerging administrative regulatory tool, administrative interviews still have problems such as lagging legislative provisions, lack of procedures and regulations, closed operation processes, risks of alienation, and lack of supervision and relief mechanisms in the operation of legislation and practice, which has some bearing on the success of administrative interviews.Internal and external interviews can be classified as administrative interviews based on their content, because the impact of external interviews on the rights and obligations of counterparts is more direct, external administrative interviews are the focus of the paper.External administrative interviews are interviews conducted by administrative bodies with their external administrative counterparts in order to prevent or eliminate minor criminal acts. For external interviews, the current legal regulations are not yet perfect, and the operational practice is gradually deviating from its original intention. In this regard, the path to improving the administrative interview system's rule of law is to unify the system's basic principles, and it's even more important to improve the administrative interview system's legislation, standardize administrative interview procedures, strengthen the administrative interview system's implementation supervision, and strengthen the administrative interview relief mechanism in order to establish the rule of law in the administrative interview system.
