Research On The Difficult Problem Of Using Influence To Accept Bribes

Criminal Law is an indispensable legal weapon to punish and prevent corruption.It is an important part of the system of punishing and preventing corruption in our country and plays an active role,combining the anti-corruption form and judicial practice in our country,Amendment VII to the Criminal Law of the People’s Republic of China puts forward the bribery by using the influence,formally making this act into a separate crime,which is the national staff of "people around",to take advantage of the facilities created by the authority or status of the national staff in order to obtain an undue advantage for the client,and take money or property for oneself.The introduction of this crime is an important step forward in China’s criminal legislation and represents China’s further integration with the international community in punishing bribery crimes,it shows that our country attaches great importance to anti-corruption and is determined to combat various forms of bribery crimes,however,there are many different views on the subject,the objective aspect,the accomplished standard and discernment similar crimes of bribery by using the influence.Analysis and argumentation of the above-mentioned controversial parts,will solve the judicial practice to meet the difficult position,thus more accurate and effective attack the crime of accepting bribes.
