A Comparative Study Of Securities Laws In China And Mongolia

Mongolia enacted the Securities Law in 1994,and revised it twice in 1999 and2013.Through the improvement of relevant laws and systems,it continuously develops the securities market and sets up relevant supporting measures to provide effective guarantee for its development and realize the standardized development of the market.China is an important neighboring country of Mongolia.With the effective docking of China's "one belt and one road initiative" and the "grassland road" strategy of Mongolia,the two countries have deepened their communication and exchanges in politics,economy,culture and society after building a comprehensive strategic partnership.In order to make the exchanges smoother,avoid the differences and differences in the future exchanges between the two countries,and promote the comprehensive reform of the Mongolian securities market,this paper makes a comparative study of the securities laws of China and Mongolia,hoping to find out the shortcomings of the securities laws of Mongolia and learn from the effective experience of China.Firstly,this paper compares the historical development of the securities laws of the two countries,analyses the development history and current situation of the securities laws of the two countries,and analyses their characteristics in the course of their development;secondly,it analyses the legislative status quo of the two countries,analyses the legislative style and content of the two countries,and then makes a comparative analysis;thirdly,it analyses the problems existing in the securities laws of Mongolia,including: Including Mongolian capital market is relatively weak,Mongolian securities legal system is not perfect,Mongolian securities legal supervision is not complete,and Mongolia lacks the necessary legal supporting system.It also analyses the experience that can be used for reference in China's securities legal system,including the more standardized capital market,the more sound relevant legal system in China,the more complete securities regulatory system in China,and the more complete relevant supporting system in China.It also makes a re-analysis of the relevant suggestions for the improvement of Mongolia's securities legal system,including the construction and strengthening of a sound securities legal system.At last,it analyses the suggestions of cooperation between China andMongolia in the securities market.The two countries should strengthen the research and docking of the securities legal system,strive to establish an effective negotiation and consultation mechanism,strengthen information exchange and mutual trust mechanism,and strengthen the related infrastructure construction.
