As an important part of the civil law system,the will guardianship system has received a great deal of attention from experts and scholars.The 2017 General Principles of Civil Code added many unprecedented provisions to the guardianship system.The newly promulgated and enforced "Civil Code of the People's Republic of China" also stipulates a will guardianship system.The establishment of a will guardianship system is based on the better protection of the ward's legal rights and interests,as the family is the foundation of the country and the harmony and well-being of the family guarantees the stable and long-term development of the country.However,the will guardianship system is not perfect,and there is an urgent need for judicial interpretation and administrative agencies to escort the implementation of the will guardianship system in order to form a will-guardianship system that can withstand trials.This article first introduces the latest research results of domestic and foreign scholars on the will guardianship system,then discusses the regulations of other countries on the will guardianship system,and based on this,the current legality of will guardianship in my country.Analyze the regulation.,And discuss the functions and functions of the current will guardian.Existing problems to finally provide suggestions for solving the problems of the will guardian,through considering the studies of domestic and foreign scholars in this field.
