In numerous kinds of crimes,although cyber violence seems to be ordinary,however,its concept of definition,reasons and forms are not clearly defined in the Criminal Law of the People's Republic of China,which makes frequent cyber violence not effectively suppressed,and the prevention function of China's criminal law does not play a full role.Starting from the causes and classification of internet violence,this paper summarizes the current regulation status of online violence crime by criminal law and puts forward some problems,such as unclear interpretation of citizens' personal information and unclear distinction between criminal law and other departments' laws when the criminal law regulates online violence by human flesh research.As for some problems,for example,while regulating violence of internet rumors,freedom of speech and network rumors were not distinguished and the penalty of internet rumor crime was relatively low,the paper suggests that the duty and responsibility of the network platform should be set systematically and scientifically,the legal punishment of related crimes should be increased,the traditional crime of defamation should be distinguished from the crime of defamation by using the network,and the education of network violence should be strengthened.
