A Study On The Protection Of Victims' Rights In The Leniency System Of Admitting Guilt And Accepting Punishment

The system of leniency for guilty pleas has played an important role in promoting the separation of complicated and simple cases and improving the efficiency of litigation since its pilot in 2016.With the constant improvement of system and development,however,it is not hard to find,whether in the legislative level or academic research level is too much emphasis on the accused person’s rights,relatively ignoring the rights of the victims,it also caused the victim’s right to know the shortage in the judicial practice,opinion influence is weak,difficult to make the claims and trapped in relief.Although the system of leniency of punishment for guilty plea needs to reflect its efficiency value,it should not neglect the protection of the rights of the victim.Greater reason by interpretation pleaded guilty to forfeit the victim rights necessity in system,found that the current pleaded guilty to forfeit their specific problems from the system of the victim rights,analyzing the causes,examining outside a similar system on the victim,the rules of the protection of the rights to sum up the experiences of its historical development and to explore the enlightenment of outside system of our country,and combining the actual situation in the current system operation,aiming at the existing problems,puts forward Suggestions with reference,in order to make system run more reasonable and stable.
