Research On The Crime Of Environmental Pollution From The Perspective Of Ecocentrism

From the crime of major environmental pollution accident to the crime of environmental pollution,after many revisions,the protection of legal interest is gradually clear.In our country,we need to determine the concept of ecological centered legal interest.The concept of eco centered legal interest refers to the concept of legal interest that focuses on protecting the ecological environment,supplemented by protecting the national management system,personal safety and public and private property.There are some problems in the identification of environmental pollution crime in China,such as unclear subjective identification,difficulty in proving causality,mismatch between limitation of action and the characteristics of environmental pollution crime itself,and distinction between environmental pollution crime and the crime of throwing dangerous substances.Under the guidance of the concept of ecological centered legal interest,we can start from the following aspects to improve the identification of environmental pollution crime To adapt to the punishment,we should entrust specialized agencies to investigate and collect evidence,make clear the infringement of legal interests,extend the time limit of prosecution,and distinguish between the crime of polluting the environment and the crime of throwing dangerous substances.
