In recent years,the rapid development of China's economy has greatly promoted the development of construction enterprises.Construction enterprises have created a large number of jobs,which play a huge role in stabilizing employment and promoting production.More and more rural surplus labor force is transferred from the countryside to the city.Among many problems about migrant workers,the labor dispute of migrant workers in the construction industry has the greatest impact on the society.The labor disputes of migrant workers are becoming more and more complex,and it is very difficult to solve them.Because of their low quality,low legal awareness and lack of protection awareness of their own rights and interests,many problems have seriously affected the stability of society and the healthy development of the construction industry.Based on the research results of various scholars on migrant workers over the years,this paper studies migrant workers' labor disputes and their disposal in the construction industry through literature research,case study and investigation.Based on the cooperative governance theory and conflict management theory,this paper analyzes the characteristics,problems and causes of labor disputes of migrant workers in the construction industry under the project subcontracting format,and takes CSCEC s as an example The case of enterprise labor dispute is the research object.Combined with the research results and the first-hand information collected,this paper makes an in-depth analysis of the problem of labor dispute in a case of enterprise and the necessity of improvement,and puts forward countermeasures and suggestions for improving the treatment of labor dispute of migrant workers in China's construction industry under the project subcontracting business.This paper analyzes the causes of labor disputes of migrant workers in the construction industry,mainly including the increasingly competitive social environment of construction enterprises,the defects of subcontracting system,the inadequacy of government management,and the defects of legal system.Based on the analysis of conflict management and cooperative governance theory,it puts forwardthe improvement measures for labor disputes: first,to build and improve the relevant legal system and social security system,The second is to actively use the theory of cooperative governance to improve the efficiency of government law enforcement;the third is to establish early warning and emergency mechanism for migrant workers' labor disputes;the fourth is to establish and improve the social security system of migrant workers' rights and interests;the fifth is to improve the legal consciousness of migrant workers.
