| With the advancement of artificial intelligence technology,autonomous vehicle technologies also have been developing rapidly.In the self-driving era,people’s lives will be changed considerably: for one thing,this type of future transportation can improve traffic conditions and reduce traffic congestion,thus to save the travel time spent on the way.Secondly,autonomous vehicles can alleviate environmental pollution problems by improving fuel efficiency and effectively using the infrastructure.Thirdly,road accidents can be greatly reduced with more autonomous vehicles on the road.However,technology is a double-edged sword.While autonomous vehicles bring many benefits,there are also some issues that have to be addressed: the probability of privacy leakage is increasing,and cyber security issues are invading the automotive field.The rapid development of self-driving technology has brought legislative regulation in many countries around the world,the most advanced of which is the United States.But our country’s legislation regarding to autonomous vehicles is still in its infancy.In this regard,this article will discuss the advanced legislative experience of other countries,analyze the problems existing in China’s autonomous vehicle legislation,and provide suggestions for the experimental legislation of autonomous vehicle in China.This article is divided into four parts:The first part will introduce the related concepts,development history and characteristics of autonomous vehicles,elaborate the concept and connotation of experimental legislation for autonomous vehicle,and discuss the necessity and scientificity of experimental legislation for autonomous vehicles.The second part will expound the current status of China’s autonomous vehicle experimental legislation from the local and central levels,and briefly analyze some problems in China’s experimental legislation of autonomous vehicle.The third part will discuss the legislative practice of autonomous vehicles in American states,federal government and other countries from the perspective of comparative method,and sum up a few worthy experiences about autonomous vehicle experimental legislation in China from these areas.In the fourth part,the author will first discuss the general principles that China’s experimental legislation in autonomous vehicles should follow,and then state the choice of experimental legislative models for China’s autonomous vehicles,and finally,put forward some specific suggestions. |
