On The Selection And Appointment System Of Bankruptcy Administrators

Based on the comprehensive consideration of the protection of creditors' interests and the salvage of debtors,China's enterprise bankruptcy law has established the bankruptcy administrator system.As the essence of commercial legislation,the administrator system plays a decisive role in the bankruptcy proceedings.If the court wants to select managers with professional quality and ability according to the legislative spirit of the enterprise bankruptcy law,it should constantly improve the selection system of managers and optimize the selection method.Starting from the selection mechanism of the bankruptcy administrator,this paper introduces in detail the selection qualification of the administrator,the selection method and the selection system of the bankruptcy administrator in our country,and makes an in-depth analysis of the shortcomings of the selection system of the administrator.Based on the consideration of the selection system of the bankruptcy administrator,the author puts forward some suggestions,such as the establishment of a diversified selection subject and the improvement of the access and assessment mechanism of the administrator's qualification.The purpose of these suggestions is to make the selection system of the administrator more scientific and perfect so as to ensure the development of the bankruptcy procedure on a professional and standardized track.
