Research On Forgiveness System Of Antitrust Law

Leniency policy is not a new system in our country,it has been introduced into our country for many years.The Leniency policy is mainly used in monopoly agreement.The second paragraph of Article 46 of China's Anti-monopoly law aims to make monopoly agreement participants provide evidence actively in exchange for their leniency.In Europe,the United States and Japan,the Leniency policy is more mature,while China has made clear regulations on the Leniency policy,but the regulations are too simple and principled,the operability is weak.This paper starts with the cases,finds out some problems in the implementation of the Leniency policy in the process of using,and finds out the shortcomings in the regulations of the Leniency policy in China.Then,the paper analyzes the applicable regulations of Leniency policy in developed countries such as Europe,America and Japan,and selectively transplants them into China.In the end,the author summarizes the suggestions to promote the Leniency policy in China based on the analysis of the problems in the cases and the advantages found in the use of forgiveness system in other countries.
