Research On The Legal Relationship Between Online Car-hailing Platforms And Drivers

As the most representative and successful industry in the sharing economy,ride-hailing has entered the public life with its convenience and novelty.However,it also brings new challenges,such as passenger safety guarantee,liability for breach of contract and tort liability,and how to identify the legal relationship between the platform and the driver? These are practical problems that need to be solved urgently.There is no labor contract between the online car-hailing platform and the driver,and the relationship between the two is highly flexible.It is difficult to protect the legitimate rights and interests of the driver,and there is no accurate identification of the relationship between the two in legislation.Therefore,the author discusses the legal relationship between online car hailing platform and drivers by straightening out the types of online car hailing,relevant existing laws and other countries' solutions to these problems.This paper divides the research problem into four parts to discuss.The first chapter mainly discusses the connotation dilemma and classification of online car hailing.The second chapter mainly discusses the different theories of the legal relationship between Uber and drivers in China,and introduces the recognition of the relationship between Uber and drivers in foreign countries,mainly Britain and the United States.The third chapter mainly discusses that the legal relationship between online car hailing platforms and drivers in China cannot be simply identified as a legal relationship,but should be identified according to the different operation modes of online car hailing.The last chapter discusses the impact of the relationship between them on other issues,including traffic accident compensation and the protection of drivers' rights and interests.
