In the late feudal society of the Qing Dynasty,chivalrous novels combined with public case novels,and formed chivalrous public case novels with honest officials and swordsmen as the protagonists and judicial activities as the main content.In this type of novels,the "Xing Xia" officials and the "official" chivalrous do chivalrous things through judicial channels,punish violence and protect the people,help the poor and uphold justice,which is praised by the people.From the perspective of law,we can find that the judicial "Xing Xia" story under the confluence of chivalry and case novels reflects the people’s dissatisfaction with the actual judicial situation and their desire to make up and amend it.In this paper,the Qing Dynasty chivalrous novel "three chivalrous five justice","Shi Gong case","Shi Gong case after biography","Peng Gong case","Di Gong case" as the research object,is divided into three parts:introduction,text,conclusion.The introduction part mainly summarizes the purpose and significance of the topic,the related research status and the innovation of this paper.There are four chapters in the main body.The first chapter is about the related concepts and connotations of Chinese ancient judicial "Xing Xia".This part starts from the concept of "Xia",and examines the emergence and development of "Xia" and the traditional Chinese culture of Xia,on the basis of which to explain the relationship between justice and"Xing Xia" and what is the story of judicial "Xia Xia",And analyze the reasons for the confluence of chivalrous cases novels in the Qing Dynasty.The second chapter is about the types and characteristics of chivalrous stories in Qing Dynasty.This part divides the stories in the chivalrous novels of Qing Dynasty into three types according to the different subjects:the "judicial activities"carried out by the chivalrous men alone,the judicial activities carried out by the officials alone,and the judicial activities carried out by the cooperation between the chivalrous men and the officials.Through the stories in the novel,the characteristics of these three types of "judicial activities" are summarized and compared.The third chapter is the analysis of the function of the officials and swordsmen in the judicial "Xing Xia" story.This part mainly analyzes the judicial activities of the cooperation between the officials and the chivalrous,that is,the judicial "Xing Xia" stories in the chivalrous novels.Through the analysis of the roles and functions of officials and swordsmen in the story,we can find out the shortcomings of the reality of justice that the people want to correct and make up.The fourth chapter is the folk judicial desire reflected in the judicial "Xing Xia" story.This part,based on the investigation of the creation of the judicial "Xing Xia" story and the relevant judicial situation in the prevailing period,identifies the part that belongs to the expression of subjective desire,and elaborates and demonstrates the folk desire reflected in the chivalrous novels of the Qing Dynasty from the five aspects of judicial power,judicial behavior,judicial procedure,judicial judgment and judicial supervision.The conclusion part is the exit and Contemporary Enlightenment of chivalrous case novels.This part will describe the gradual fading process of chivalrous novels,and elaborate its four enlightenments to contemporary judicial activities.
