This paper takes 15 cases in China open trial network as the main research corpus and judges' discourse as the main research object.Based on linguistic research and legal knowledge,we can study judge's discourse from a more comprehensive.Judge discourse belongs to court discourse.Through the observation and extraction of corpus,we first analyze the institutional role of judges.Judges are at the top of the court power relationship and are the direct embodiment of institutional power.With the change of the trial stage,the role of judges is constantly changing.Different roles will have different discourse performance,and the discourse performance of judges will reflect and strengthen their power status.Then,based on discourse analysis and critical discourse analysis,we analyze the discourse power of judges in Courtroom Conversation from three aspects: deixis,speech act,politeness and impoliteness,and summarize the discourse strategies used by judges in controlling discourse power with examples.Finally,we discuss the standardization of judge discourse and judicial justice,as well as the possible social and practical impact of the study. |
