Research On Legal Issues Of Municipal Solid Waste Management

For purpose of solve the increasingly serious waste-pollution issues in our country,since the local-pilot policy of urban household-waste classification in 1992,our country has actively explored the construction of urban household-waste-management legal system.However,there are still some unsettles issues.Therefore,feasible analysis and solutions of these legal issues existing in practical managements have become the fundamental prerequisites and base for improving the current situation of urban household-waste managements and promoting future sound development.Based on a batch of analysis upon relevant theories existing in our country,and with combination of the current investigations around the current condition of legislation and law enforcement,this paper turns out that there are totally the following four legal issues in our country,namely from eco-ethical dilemma,legislative concept,principle and model,there are many disconnections in practical operations,fractures with the responsibilities and obligations of relevant subjects in the entire legal system,as well as phenomena disembedded in constructing and practicing specific legal systems throughput our country.Actually,the above four legal aspects can be said as a general summary of the existing many factors hindering the practical managements of urban household-waste managements in our country.Therefore,in order to solute these issues,it’s of necessity for us to adjust the current legislative concepts,principles and models,reconstruct the responsibilities and obligations of relevant subjects,as well as improve supporting systems accordingly for promoting the transformation of people’s lifestyles and habits,as well as pushing final standardization and legalization of urban household-waste-managements in our country in future.
