Even if the plaintiff wins in the environmental in litigation In the environmental public interest litigation,then the purpose of the court's judgment can not really be realized.The reasonable and effective management of compensation is related to the interests of the plaintiff,the defendant and the general public involved in environmental public welfare.Many scholars have pointed out that only by implementing the use norms and operation rules of compensation as soon as possible can we really ensure the interests of the people.Since the promulgation of trust law in 2001,China's public trust industry has made great progress.The public trust system has also been improved and developed.More and more scholars try to introduce this shining pearl in the common law system into China.We can also learn from foreign countries for environmental public interest litigation compensation management,compensation and public trust will be combined.This not only broadens the mechanism of environmental relief,but also helps to better control pollution and repair the damaged environment.In practice,there are also some problems in the use of compensation management.We can find a better fund management mechanism(I think)that is the public trust.The trustor of the public trust for compensation is the government,the trustee is a professional organization,and the supervisor is the government environmental protection organization and other supervision subjects.Compensation is the trust property for the purpose of repairing the environment.In this kind of trust system,it can make better use of funds to achieve the purpose of repairing the environment,and also can guarantee the real independence of compensation.
