Research On Pre-litigation Procuratorial Suggestions For Environmental Administrative Public Interest Litigation

In recent years,with the high-fiying Chinese economy,many provinces and cities exchange economic benefits at the expense of the environment.With the continuous awakening of people’s awareness of environmental protection,more and more people realize the importance of preservation of environment.It is an important part of economic development of Ecological civilization construction.Pre litigation procuratorial suggestion is a supervision proposal issued by the procuratorial organ to the environmental protection administrative organ before initiating the environmental administrative public interest litigation.It not only saves the judicial resources,but also plays a role of case diversion while protecting the environment.At present,there are some problems in the pre litigation procuratorial suggestion,such as the lack of concrete system and procedure.Therefore,this paper studies the legal principle,legitimacy and necessity of the pre litigation procuratorial advice in environmental administrative public interest litigation,puts forward the ways to solve and improve it,refines the connection between the procuratorial suggestion and public interest litigation,and may change it Difficulties in the implementation of procuratorial suggestions in reality.
