With the rapid development of society and the deepening of industrialization,the risks faced by laborers in social production are also increasing.However,the frequent work-related injury has brought great threat to the life of workers and it has become an important social problem.In all work-related injury,there is a kind of work-related injury case here is more complex,that is the work-related injury caused by traffic accident.There has always been a lot of controversy about this kind of problem.The law of our country does not make a clear provision for the compensation mode applicable when the compensation for work injury insurance and the third-party infringement compensation in traffic accident exist simultaneously.As a result,the verdict and compensation results of similar cases in different regions of China are quite different.In the case of this kind of work-related injury,how to protect the interests of workers and balance the interests of all parties at the same time is also necessary to consider when designing the relevant system.In the First chapter,the background and significance of the topic are discussed in combination with literature and actual cases.In Chapter two,this paper introduces and evaluates the four compensation modes of work-related injuries caused by traffic accidents on the basis of relevant literature.In the Third chapter,taking Zhejiang Province as an example,this paper introduces and evaluates the compensation model of work-related injury caused by traffic accident in this area.In the Fourth chapter,this paper introduces the principle of work-related injury compensation,and tries to improve the existing compensation model of Zhejiang Province based on four kinds of compensation models of work-related injury caused by traffic accidents.In Chapter5,based on the above analysis,an improved compensation mode for work-related injuries caused by traffic accidents is proposed by combining the selection mode,the supplement mode and the cumulaion mode,that is,the compensatory mode is selected,and the mode is evaluated by interviewing relevant personnel. |
