Labor dispatch,as an atypical way of employment,arises because the traditional way of employment cannot meet the needs of large-scale machine production,and is an inevitable product of the development of the labor market.China’s labor dispatching basically develops with the development of the market economy,and its generation time is not long,but it has developed rapidly in recent years and has gained some successful experience.As a form of supplementary employment,labor dispatching has the advantages of simple management procedures,lower responsibilities and risks,independent and flexible employment,and lower economic costs.It can effectively promote the further development and maturity of the labor market.The Labor Contract Law,which came into effect in 2008,specifically stipulates the labor dispatch as a form of employment in Section 2 of Chapter V.The Labor Contract Law,which was revised and entered into force in 2013,once again revised the labor dispatch system,and then a series of rules and regulations have been issued to make the labor dispatch system more operational.However,there are still many unsolved problems in China’s labor dispatch system,and many problems are exposed,which deserves the attention of the theoretical and practical circles.In addition to the introduction,this paper is mainly composed of the following parts: The first part is to analyze the inadequacy of China’s labor dispatch system from five aspects,the applicable positions from labor dispatch are not clear and specific,the subject’s access qualification is too low,the equal pay system for equal work is too principled,and the responsibility distribution system is not as reasonable as possible and there is the issue of absence of the return system.The second part is the investigation of the theoretical research and system construction of labor dispatching in developed countries outside the region and the enlightenment to our country.Based on the above five shortcomings,the labor dispatching systems of the United States,Japan,Germany and other countries are investigated and analyzed.It is found that China’s labor dispatch system can learn from them.The third part is to make targeted suggestions on the above five issues and improve our labor dispatch system.
