| The revised Legislation Law in 2015 clearly endowed each districted city with legislative power,so that the main body of local legislative power was expanded from a larger city to a city divided into districts,and a city divided into districts became an independent legislative level.The revision of the Legislation Law this time not only makes up for the shortcomings of the original legislative system,but also further promotes the process of the rule of law in my country to comprehensively promote the rule of law.Since the revision of the Legislative Law,cities divided into districts have had legislative power for more than six years.With the continuous improvement of legislative technology,a number of creative and local regulations have emerged.However,due to the differences in local development,not all cities with districts have achieved remarkable results,and a considerable number of cities with districts are still in the exploratory stage,and they have some generally similar problems in the process of legislative practice..This article takes the legislative practice of the cities（prefectures）divided into districts in Gansu Province for the past six years,and analyzes the problems existing in the legislation of the cities（prefectures）divided into districts in my country,and proposes corresponding solutions according to the problems,so as to make the District municipalities better exercise their local legislative powers.Based on a comprehensive review of the current situation of local legislation in cities（prefectures）divided into districts in Gansu Province,this paper systematically analyzes the root causes of local legislation in cities divided into districts in Gansu Province.The author analyzes the problems existing in local legislative practice from four perspectives: legislative subject,legislative content,legislative process and legislative supervision.Then,from the perspective of combining theory with practice,the corresponding solutions are given: first,in terms of legislative subjects,it is necessary to strengthen the leading role of the National People’s Congress in legislation,improve public participation in legislation,and strengthen the construction of legislative teams;second,in terms of legislative content,it is necessary to Follow the "non-contradictory" principle,and legislation reflects local characteristics;thirdly,in terms of the legislative process,the legislative procedure must be improved from the stages of project initiation,drafting,proposal,deliberation,voting,and announcement;finally,at the level of the legislative supervision system,it must be reviewed and approved.and filing review to improve.By putting forward these four cracking measures,we can promote the smooth operation of the legislative power of the city divided into districts,so as to better promote the local social and economic development. |
